Terms of service

Updated

These terms apply when a business (“you”) uses Pufflo, a service from Plain Sight AS, org. no. 935 659 167, Kleiverveien 28, 3440 Røyken, Norway (“we”, “us”). By creating an account or using Pufflo, you accept these terms on behalf of your business. Pufflo is made for businesses, not for consumers.

1. What Pufflo is

Pufflo is an AI marketing service. It collects results from the accounts you connect (such as Google Search Console, Google Analytics, Google Ads, Google Business Profile and Meta), finds improvements, and lets AI agents do the work: write content, fix technical problems on your website, improve how you show up in AI assistants and adjust ads. Pufflo can also host your website.

2. Your account

  • You must give correct information and keep your sign-in secure.
  • The person who creates the account must be allowed to act for the business and to connect its accounts.
  • You can invite colleagues. You are responsible for what happens in your account.

3. Approvals and autopilot

  • Nothing changes in your website, ads or listings unless you approve it, or you have turned on autopilot for that area. You can turn autopilot off at any time.
  • Everything the agents do is logged in the app. Where possible, you can undo a change.
  • You are responsible for checking suggestions before you approve them, and for the choices you make about autopilot.

4. Connected accounts

  • You choose which accounts to connect and what access to give. Access is read-only by default.
  • You stay the owner of your accounts, ad spend, data and website address. Ad spend is paid directly to Google, Meta and others on your own accounts, under their terms.
  • You can disconnect an account at any time in the app or with the provider.

5. Your website

  • If Pufflo hosts your website, we build a new site or convert your current one: we move your content, keep your web address and set up redirects from old pages.
  • You keep the rights to your content, logo and web address. If you leave, we help you take your content with you, and you keep your domain.
  • If you connect a website you host elsewhere, you are responsible for that hosting and for changes made outside Pufflo.

6. AI-generated content

  • Pufflo uses AI to write suggestions, texts and pages. AI can make mistakes. Check content before you approve it, especially facts, prices and claims about your business.
  • You are responsible for content published on your website and in your ads, including that it follows marketing law and the platforms’ rules.
  • You own the content Pufflo creates for you, to the extent the law allows.

7. No guarantees of rankings or results

Google, Meta and AI assistants decide their own results. We do the work that makes it more likely that customers find you, but we cannot guarantee rankings, positions in AI answers, traffic, leads or sales.

8. Prices and payment

  • Prices are shown on the pricing page, excluding VAT. VAT is added where required.
  • You can pay monthly or yearly, in advance. Yearly payment costs the same as 10 months (two months free).
  • There is no binding period: you can change plan or cancel at any time, and the change takes effect from the next period. If you cancel a yearly plan, it runs until the end of the year you paid for.
  • 30-day money-back guarantee: if you are not happy, tell us within 30 days of your first payment and we refund it in full – for monthly and yearly plans and the website add-on. Later payments are not refunded, except where the law says otherwise.
  • A launch offer (such as 50 % off the first three months on monthly payment) applies to businesses that sign up while it is shown on the pricing page, as described there. We can end the offer for new sign-ups at any time; customers who already have it keep it for the period they were promised.
  • We can change prices with at least 30 days’ notice. If you don’t accept the change, you can cancel before it takes effect.
  • If payment fails, we may pause the service after notice.

9. Fair use

You may not use Pufflo to break the law, to publish misleading, infringing or harmful content, to buy or fake reviews, to send spam, or to try to access other customers’ data or our systems. We may suspend accounts that break these rules.

10. Data protection

  • Our privacy policy explains how we handle personal data.
  • When we process personal data on behalf of your business, we act as your data processor and you are the controller. This section is our data processing agreement under GDPR article 28:
    • What, why and how long: we process the personal data in the accounts and websites you connect and in your Pufflo account (for example contact details, visitor and customer statistics, reviews and messages) about your customers, visitors, contacts and employees, only to deliver Pufflo, for as long as the agreement lasts.
    • Your instructions: we process the data only on your documented instructions, which are these terms, your settings and your approvals in the app. If we think an instruction breaks data protection law, we tell you.
    • Confidentiality: everyone who can access the data is bound by confidentiality.
    • Security: we take the measures required by GDPR article 32, including encryption in transit, encrypted storage of access tokens, separation between customers in the database, and access only for those who need it.
    • Sub-processors: you give general permission to use the sub-processors listed in the privacy policy. We tell you at least 30 days before we add or replace one, and you can object; if we cannot meet the objection, you can end the agreement. Each sub-processor is bound by the same data protection obligations, and we remain responsible for them.
    • Transfers: we store the data in the EU/EEA, or transfer it outside only with a valid legal basis such as the EU Standard Contractual Clauses or the EU–US Data Privacy Framework.
    • Helping you: we help you answer requests from data subjects, and with security, breach notification, data protection impact assessments and prior consultation (GDPR articles 32–36), as far as our role allows.
    • Breaches: we tell you without undue delay, and no later than 48 hours, after we become aware of a personal data breach.
    • When the agreement ends: we delete the data within 30 days, or return it first if you ask, unless the law requires us to keep it.
    • Audits: we give you the information needed to show that we follow this section, and allow and contribute to reasonable audits, with reasonable notice.

11. Availability and changes to the service

We work to keep Pufflo available and secure, but we can’t promise that it will always be free of errors or interruptions. We develop the service continuously and may change or remove features. If we remove something important you pay for, we tell you in advance.

12. Liability

  • We are not liable for indirect losses, such as lost profit, lost revenue or lost data, or for results on Google, Meta or in AI assistants.
  • Our total liability in a 12-month period is limited to what you paid us in that period.
  • These limits do not apply to gross negligence or intent.

13. Ending the agreement

You can cancel at any time in the app. We can end the agreement with 30 days’ notice, or straight away if these terms are seriously broken. After the agreement ends, we delete your data as described in the privacy policy.

14. Changes to these terms

We may update these terms. We tell you about important changes in the app or by email at least 30 days before they take effect.

15. Law and disputes

These terms are governed by Norwegian law. We will first try to solve a disagreement by talking. Disputes that cannot be solved go to Oslo District Court (Oslo tingrett) as the agreed venue.
